Rules and Regulations
As a regulated utility, New Mexico Gas Company (NMGC) operates under rules and regulations set by the New Mexico Public Regulation Commission (NMPRC).
NMGC has adopted standard rates and rules to govern our relations with customers. These have been approved by the NMPRC.
Cases Before the New Mexico Public Regulation Commission
NMPRC Case No. 24-00266-UT: 2024 Application to Purchase New Mexico Gas Company
On May 20, 2026, hearing examiners for the New Mexico Public Regulation Commission recommended approval of the proposed sale of New Mexico Gas Company to Bernhard Capital Partners. The sale still requires consideration and final approval by NMPRC Commissioners. This will occur during an upcoming public meeting of the Commission, although no date has been determined.

Case Proceedings
On July 3, 2025, BCP, NMGC and Emera Inc. filed a revised joint application to the New Mexico Public Regulation Commission for approval of the sale of NMGC to BCP. The Commission began a public hearing on the proposed acquisition on November 3, 2025, and concluded on November 14, 2025.

On May 27, 2025, a group of interested parties submitted a motion to dismiss the application. That document can be seen here. The response to that motion by the joint applicants, filed on June 2, 2025, can be viewed here. Next was a reply by the interested parties, filed June 6, 2025, to the response by the joint applicants, which can be seen here. On June 12, 2025, the hearing officers vacated the prehearing and hearing dates for the case. That document can be viewed here. On June 30, 2025, the Hearing Examiners ordered the joint applicants to file a revised application. That document can be found here.
A public comment hearing was held on Tuesday, October 28, 2025, at the NM811 office in Albuquerque. The order scheduling the hearing is here. Written public comments may be submitted before the Commission takes final action. Those comments should reference Case No. 24-00266-UT and be emailed to PRC.Records@prc.nm.gov. Public comments, whether oral or written, shall not be considered as evidence in this proceeding.
2026 Application to Issue Longterm Debt
On April 17, 2026, NMGC filed an application with the New Mexico Public Regulation Commission seeking approval and authorization to issue up to $140 million in unsecured notes with potential terms between five and thirty years.

2026 - 2028 Energy Efficiency Three Year Plan
On September 2, 2025, NMGC filed an application with the New Mexico Public Regulation Commission seeking approval of its Energy Efficiency program for years 2026 - 2028. The Commission approved the application on July 2, 2026, and issued a Final Order, which can be found here.

2025 Annual Energy Efficiency/Measurement and Verification Report
